Legally, having a blood alcohol concentration when driving a vehicle is one of the prohibited acts as prescribed in Article 8 of the 2008 Road Traffic Law.
Pursuant to the provisions of Article 5, Article 6, Decree 100/2019/ND-CP stipulating penalties for administrative violations in the field of road and rail traffic, penalizing drivers of cars and other types of vehicles similar to cars; motorbikes, mopeds (including electric motorbikes), motorbike-like vehicles and moped-like vehicles; tractors and specialized motorbikes violating road traffic rules:
For drivers of cars and similar vehicles:
- A fine from 6,000,000 VND to 8,000,000 VND shall be imposed on drivers on the road whose blood or breath alcohol concentration does not exceed 50 milligrams/100 milliliters of blood or does not exceed 0.25 milligrams/1 liter of breath. The driver will also be subject to an additional penalty of having his right to use his driver's license revoked for 10 to 12 months.
- Fine from 16,000,000 VND to 18,000,000 VND for drivers on the road whose blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath. The driver will also be subject to an additional penalty of having his right to use his driver's license revoked from 16 to 18 months.
- Fine from 30,000,000 VND to 40,000,000 VND for drivers on the road whose blood or breath alcohol concentration exceeds 80 milligrams/100 milliliters of blood or exceeds 0.4 milligrams/1 liter of breath; The driver will also be subject to an additional penalty of having his right to use his driver's license revoked from 22 to 24 months.
For drivers of motorbikes, mopeds (including electric motorbikes), motorbike-like vehicles and moped-like vehicles:
- A fine of from 2,000,000 VND to 3,000,000 VND shall be imposed on drivers on the road whose blood or breath alcohol concentration does not exceed 50 milligrams/100 milliliters of blood or does not exceed 0.25 milligrams/1 liter of breath. The additional penalty is the loss of the right to use the driving license from 10 months to 12 months.
- A fine from 4,000,000 VND to 5,000,000 VND shall be imposed on drivers on the road whose blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath. The additional penalty is suspension of the right to use a driver's license from 16 months to 18 months.
- Fine from 6,000,000 VND to 8,000,000 VND for drivers on the road whose blood or breath alcohol concentration exceeds 80 milligrams/100 milliliters of blood or exceeds 0.4 milligrams/1 liter of breath; The driver will also be subject to an additional penalty of having his right to use his driver's license revoked from 22 to 24 months.
In addition, insurance regulations and rules also exclude insurance for people who consume alcohol that exceeds the alcohol concentration according to the provisions of the Road and Traffic Law.
According to the personal accident insurance rules of Bao Minh Insurance Company, the exclusion points in Article 5 are as follows:
